§ 1 Geltungsbereich
(1) Die nachstehenden „Allgemeinen Geschäftsbedingungen“ gelten für die Veranstaltungen „4th International Physical Internet Conference“ im Folgenden genannt „IPIC17“. Abweichende Vereinbarungen bedürfen der Schriftform. Mit seiner Anmeldung zu der Veranstaltung erklärt sich der Teilnehmer mit diesen „Allgemeinen Geschäftsbedingungen“ (AGB) einverstanden und an sie gebunden.
(2) Sollten einzelne Bestimmungen dieser AGB zwingenden gesetzlichen Vorschriften (insbesondere den Bestimmungen des KSchG) widersprechen, so behalten die übrigen Bestimmungen dieser AGB dennoch ihre Gültigkeit.
§ 2 Anmeldung
(1) Die Veranstalter der IPIC17 behalten sich das Recht vor, das jeweilige Leistungsangebot inhaltlich jederzeit zu verändern. Alle Angebote der IPIC17 sind freibleibend. Der Vertrag kommt durch Annahme der Anmeldung durch die Veranstalter der IPIC17 zustande. Die Veranstalter der IPIC17 behalten sich das Recht vor, einem Teilnehmer die Konferenzteilnahme zu versagen, unabhängig von Zeitpunkt und Art der Anmeldung.
(2) Anmeldungen werden in der Reihenfolge ihres Eintreffens nach verfügbarer Teilnehmerzahl berücksichtigt, Anmeldungen werden über die Online-Registrierung (auch schriftlich, per Fax und E-Mail) entgegengenommen. Jede Anmeldung ist verbindlich. Pro Person ist eine Anmeldung erforderlich. Die Anmeldung kann nicht auf andere Personen übertragen werden.
§ 3 Vertragssprache
Der Vertragsinhalt, alle sonstigen Informationen, Kundendienst und Beschwerdeerledigung werden durchgängig in deutscher und englischer Sprache angeboten.
§ 4 Stornierungen
(1) Stornierungen können nur schriftlich (Fax, Brief) entgegengenommen werden. Grundlage für die Berechnung einer Stornierungsgebühr ist das Datum des Mitteilungseingangs bei den Veranstaltern der IPIC17.
(2) Bei einer Stornierung bis 30 Tage vor Veranstaltungsbeginn muss eine Stornogebühr von € 50 verrechnet werden. Bei Abmeldungen, die zwischen 30 und 11 Tage vor Veranstaltungsbeginn einlangen muss eine Stornogebühr von € 100 verrechnet werden. Bei Abmeldungen, die später als 11 Tage vor Veranstaltungsbeginn einlangen, wird bei Nichtbesuch der komplette Teilnahmebeitrag fällig.
(3) Die Benennung eines Ersatzteilnehmers ist jederzeit kostenfrei möglich.
§ 5 Rücktrittsrecht im Fernabsatz
(1) Teilnehmer, die Verbraucher im Sinne des Konsumentenschutzgesetzes sind, können binnen 14 Werktagen ab Bestelldatum, ohne Angabe von Gründen, jedoch nur vor Leistungsbeginn zurücktreten. Sollte der Leistungsbeginn schon eingetreten sein, besteht kein Rücktrittsrecht mehr. Es genügt, wenn die Rücktrittserklärung innerhalb dieser Frist abgesendet wird.
(2) Bereits bezahlte Teilnehmerbeiträge werden im Falle des Rücktritts an den Teilnehmer zurückerstattet.
(3) Kein Rücktrittsrecht besteht, wenn die Veranstaltung programmgemäß bereits innerhalb dieser Rücktrittsfrist stattfinden.

§ 6 Preise
(1) Grundsätzlich gilt jener Teilnahmebeitrag als vereinbart, der sich aus den aktuellen Prospekten, Katalogen, Preislisten, Website und ähnlichen Publikationen der IPIC17 ergibt.
(2) Soweit nicht anders angegeben, verstehen sich sämtliche Preisangaben als Bruttopreise einschließlich der gesetzlichen Umsatzsteuer.
§ 7 Zahlungsbedingungen
(1) Die Teilnahmegebühr ist sofort nach Rechnungserhalt abzugs- und spesenfrei zu entrichten. Eine Teilnahme kann nur gewährt werden, wenn die Zahlung vor Veranstaltungstermin beim Veranstalter eingegangen ist oder der Rechnungsbetrag am Veranstaltungstag bei der Registrierung beglichen wird. Bei Überweisung des Rechnungsbetrages später als 5 Bankarbeitstage vor Veranstaltungstermin wird der Teilnehmer gebeten, dem Veranstalter unaufgefordert eine Kopie des Zahlungsbeleges bis spätestens einen Tag vor Veranstaltungstermin zu faxen. Der Teilnehmer ist angehalten, Teilnehmernamen und Rechnungsnummer auf dem Zahlungsbeleg vermerken zu lassen, damit eine zweifelsfreie Zuordnung gewährleistet ist. Sonderkonditionen für Frühbucher können nur gewährt werden, wenn der ausgewiesene Betrag spätestens am angegebenen Stichtag auf dem Konto der IPIC17 eingelangt ist.
(2) Bei einem späteren Einstieg in eine Veranstaltung ist eine Ermäßigung des Teilnahmebeitrags nicht vorgesehen, dasselbe gilt bei einem vorzeitigen Ausstieg.
(3) Bei Zahlungsverzug fallen Verzugszinsen in der Höhe von 10% p.a. an. Der Teilnehmer ist verpflichtet, den Veranstaltern der IPIC17 sämtliche durch seinen Zahlungsverzug entstehenden zur zweckentsprechenden Rechtsverfolgung notwendigen Mahn- und Inkassospesen zu ersetzen. Die Geltendmachung eines höheren Verzugsschadens behalten sich die Veranstalter der IPIC17 vor.
§ 8 Freikarten
Erhält der Teilnehmer von einem Sponsor oder vom Veranstalter eine Freikarte, die zur unentgeltlichen Teilnahme der Veranstaltung berechtigt, so gelten folgende Bestimmungen als akzeptiert: der Teilnehmer ist immer eine natürliche Person, pro Teilnehmer kann nur eine Freikarte in Anspruch genommen werden. Eine Freikarte ist nicht übertragbar, d.h. personengebunden. Die Weitergabe einer Freikarte an Dritte während Abwesenheitszeiten von der Konferenz ist unzulässig. Eine Freikarte ist nicht auszahlungsfähig und begründet bei Nichtinanspruchnahme auch keine Gültigkeit für die nächste Veranstaltung. Eine Kompensation mit anderen Leistungen ist ausgeschlossen.
§ 9 Programmänderungen/Absagen
(1) Aufgrund der langfristigen Planung der Veranstaltung behalten sich die Veranstalter der IPIC17 organisatorisch bedingte Programmänderungen wie Änderung von Terminen, Beginnzeiten, Ort oder Vortragenden sowie Veranstaltungsabsagen vor. Die Teilnehmer werden davon rechtzeitig und in geeigneter Weise verständigt.
(2) Ersatz für entstandene Aufwendungen und sonstige Ansprüche gegenüber den Veranstaltern der IPIC17 sind daraus nicht abzuleiten. Dasselbe gilt für kurzfristig notwendige Terminverschiebungen.
(3) Muss eine Veranstaltung abgesagt werden, erfolgt eine abzugsfreie Rückerstattung von bereits eingezahlten Teilnahmebeiträgen.
§ 10 Schadenersatz
(1) Die Veranstalter der IPIC17 haftet nur für Schäden bei Vorsatz und grober Fahrlässigkeit, mit Ausnahme von Schäden an Personen. Das Vorliegen von leichter bzw. grober Fahrlässigkeit hat, sofern es sich nicht um ein Verbrauchergeschäft handelt, der Geschädigte zu beweisen. Ferner können die Veranstalter der IPIC17 keine Haftung übernehmen für Schäden oder Diebstahl an den durch den Teilnehmer mitgeführten persönlichen Wertgegenständen.
(2) Der Ersatz von (Mangel-) Folgeschäden und reinen Vermögensschäden ist gegenüber Unternehmern ausgeschlossen.
(3) Für die formelle oder inhaltliche Richtigkeit der Angaben in Veranstaltungsunterlagen sowie für die vollständige Präsenz der angekündigten Referenten kann trotz sorgfältiger Vorbereitung keine Haftung durch die Veranstalter der IPIC17 übernommen werden. Für offensichtliche Irrtümer und Druckfehler bzw. Veröffentlichungen im Internet und dortigen Informationen, die per Download abrufbar sind, kann keine Haftung übernommen werden.
§ 11 Datenschutz
(1) Die Veranstalter der IPIC17 unterliegen den Geheimhalteverpflichtungen des Datenschutzgesetzes.
(2) Der Teilnehmer anerkennt, dass die Verwendung der im Vertrag angeführten Daten über den Teilnehmer für Zwecke unserer Buchhaltung und der Teilnehmerevidenz gespeichert und verarbeitet werden. Die Daten werden zur Erfüllung von gesetzlichen Vorschriften und zur Abwicklung des Zahlungsverkehrs verwendet.
(3) Teilnehmerdaten werden nicht an Dritte weitergegeben, außer dies ist für die Vertragsabwicklung unbedingt erforderlich. Vertragspartner die Veranstalter der IPIC17 sind über diese Datenschutz¬bestimmungen instruiert und entsprechend verpflichtet. Es ist den Veranstaltern der IPIC17 jedoch gestattet Daten in der bei Veranstaltungen üblichen Form (d.h. ohne E-Mail-Adresse, Telefonnummer, etc.) an die Konferenzteilnehmer weiterzugeben.
(4) Der Teilnehmer ist einverstanden, über Leistungen und Produkte der die Veranstalter der IPIC17 (Veranstaltungen, Publikationen…) auch per E-Mail informiert zu werden. Diese Zustimmung kann vom Teilnehmer jederzeit widerrufen werden.
§ 12 Gerichtsstand und anwendbares Recht
(1) Auf diesen Vertrag ist österreichisches materielles Recht unter Ausschluss des UN-Kaufrechts anzuwenden. Ist der Vertragspartner Verbraucher, so sind auch die zwingenden Bestimmungen des Rechts des Staates, in dem er seinen gewöhnlichen Aufenthalt hat, auf diesen Vertrag anzuwenden.
(2) Für Streitigkeiten ist das am Sitz der Veranstalter der IPIC17 sachlich zuständige Gericht ausschließlich zuständig. Wenn der Teilnehmer Verbraucher im Sinne des KSchG ist, gilt die Zuständigkeit jenes Gerichtes als begründet, in dessen Sprengel der Wohnsitz, der gewöhnliche Aufenthalt oder der Ort der Beschäftigung des Teilnehmers liegt.
(3) Gerichtsstand und Erfüllungsort des Vertrages ist der Sitz der Veranstalter der IPIC17.

The Logistikwerkstatt Graz website is hosted and maintained by the Institute of Logistics Engineering. The use of the Logistikwerkstatt Graz website is subject to the user’s acknowledgement of the terms of use set forth below. If the user does not accept the terms of use of the website stated below, s/he may not use the Logistikwerkstatt Graz website. By using the Logistikwerkstatt Graz website, the user accepts the terms of use. Information may also be provided by transmission of text contributions or by transmission of links to IPIC17. By transmitting information to the Logistikwerkstatt Graz website, the user automatically acknowledges the terms of use. The Logistikwerkstatt Graz website is managed, operated and administered by the registered office of the Institute of Logistics Engineering, which is situated in Austria, 8010 Graz, Kopernikusgasse 24/I. The Logistikwerkstatt Graz website and the content presented thereon can be retrieved and used worldwide. IPIC17 will disclaim all liability whatsoever for the lawfulness of the Logistikwerkstatt Graz website and the content offered thereon from the viewpoint of other jurisdictions and relevant provisions of other jurisdictions.
